Terms of sale

Short and without small print: who sells, how the contract is made, how long you have to return and what I am responsible for. If something is unclear — write before you order, not after.

The terms are not complete yet — data is missing without which they cannot take effect:

§ 1. The Seller

  1. 1.

    The Hrútr Forge online shop is run by Aleksander, a natural person carrying on an unregistered business activity within the meaning of Art. 5 of the Polish Entrepreneurs' Law (działalność nierejestrowana).

  2. 2.

    Correspondence address: contact@hrutrforge.com. At this address the Seller accepts questions, notices of withdrawal from the contract and complaints.

  3. 3.

    Contact: contact@hrutrforge.com, , during Mon–Fri, 9:00–17:00 (CET).

  4. 4.

    The Seller is not entered in the Polish business register (CEIDG) and has no NIP or REGON numbers, because the activity carried on does not constitute a business activity within the meaning of Art. 5 of the Polish Entrepreneurs' Law.

  5. 5.

    Towards consumers, however, the Seller has all the obligations of a trader under the Polish Consumer Rights Act and Civil Code — in particular, the Seller is liable for conformity of the goods with the contract and respects the right of withdrawal. The lack of registration changes nothing here.

§ 2. Definitions

  1. 1.

    Wherever these terms refer to:

    • a)the Shop — this means the Hrútr Forge website together with its subpages;
    • b)the Buyer — the person placing the order;
    • c)the Consumer — a natural person concluding a contract not directly related to their business or professional activity;
    • d)an Entrepreneur with consumer rights — a natural person running a business who concludes a contract directly related to that business, where its content shows that it is not of a professional nature for that person; such a person has the rights described in § 7 and § 8;
    • e)the Goods — an axe, spearhead or spear, a piece of jewellery, an accessory or another item offered in the Shop.

§ 3. Technical requirements and rules of use

  1. 1.

    To use the Shop you need a device with internet access and an up-to-date browser with JavaScript enabled, and an active e-mail account.

  2. 2.

    The Buyer undertakes not to provide unlawful content and to use the Shop in a way that does not disrupt its operation.

  3. 3.

    Creating an account is voluntary and free of charge. The account makes it easier to view the order history; purchases can also be made without an account.

  4. 4.

    The account can be deleted at any time — with the button in the account settings or by writing to the Seller's e-mail address. There the Buyer also changes the password and the details filled in for future orders. Deleting the account does not affect orders already placed or obligations under tax law.

§ 4. Goods and prices

  1. 1.

    Descriptions and photos of the Goods are prepared in good faith. For each item I state the dimensions, weight and type of steel; if the data comes from the manufacturer and has not been measured by me, this is stated explicitly in the specification.

  2. 2.

    The Goods are hand-forged and hand-finished. Small differences in dimensions, weight, forging marks, patina shade and wood grain compared to the photos are permitted — they do not constitute a lack of conformity of the goods with the contract.

  3. 3.

    Prices shown in the Shop are final prices, expressed in Polish złoty or — in language versions that show euro prices — in euro. The Seller is exempt from VAT and, at the Buyer's request, issues a receipt instead of a VAT invoice.

  4. 4.

    The price does not include shipping costs, which are shown when choosing the shipping method and added to the order value.

  5. 5.

    The price information is binding from the moment the order is placed. A later change of price in the Shop does not affect orders already placed.

§ 5. Order and conclusion of the contract

  1. 1.

    An order is placed by adding Goods to the cart, filling in the form and confirming with the button labelled “Order and pay”, which means an obligation to pay.

  2. 2.

    To place an order, the Buyer must provide the data needed to fulfil it and accept these terms.

  3. 3.

    After placing the order, the Buyer receives at the e-mail address provided a confirmation with the order number, list of items, price and shipping cost. The contract is concluded when this confirmation is delivered.

  4. 4.

    The Seller may refuse to fulfil an order if the Goods have become unavailable or the data is incomplete or untrue. In that case the Seller informs the Buyer without delay and refunds the full payment received.

  5. 5.

    Every change of order status is recorded and sent to the Buyer by e-mail. The order status can also be seen at the individual address given in the confirmation and — for account holders — in the “Account” tab.

§ 6. Payment and delivery

  1. 1.

    Payment is made by bank transfer to the Seller's bank account: —. The Seller also provides the transfer details in the order confirmation.

  2. 2.

    The order is processed once the payment has been received.

  3. 3.

    The shipping time is stated separately for each item, because some pieces are available immediately and some are made or sourced to order. The time is counted from receipt of payment.

  4. 4.

    Shipping costs and methods within the Republic of Poland: insured courier (DPD) — from PLN 29; personal pickup by appointment — free of charge. For orders over PLN 500, delivery within Poland is free. Parcels longer than 150 cm (e.g. complete spears with shafts) are quoted individually.

  5. 5.

    The Seller delivers Goods within Poland and to the other European Union countries. The cost of delivery outside Poland depends on the country and the chosen carrier, does not depend on the order value and starts from PLN 199; the current price list is given on the Contact page, and the amount for the chosen country and carrier is shown in the order form before the order is placed; free shipping on orders over PLN 500 applies to domestic deliveries only.

  6. 6.

    The Seller may deliver outside the European Union after agreeing the costs and shipping conditions by e-mail before the order is placed.

  7. 7.

    A Buyer ordering Goods for delivery outside Poland should make sure that the laws of the destination country allow the import of the ordered Goods. The Seller is not liable for the parcel being detained by the authorities of the destination country or for restrictions arising from carriers' terms.

  8. 8.

    An order containing several items with different shipping times is sent in full once complete, unless the parties agree otherwise.

  9. 9.

    The Seller recommends checking the condition of the parcel on receipt. A carrier's refusal to draw up a damage report does not deprive the Buyer of any rights against the Seller.

§ 7. Withdrawal from the contract

  1. 1.

    The Consumer and an Entrepreneur with consumer rights may withdraw from the contract without giving a reason within 14 days of taking possession of the Goods.

  2. 2.

    To meet the deadline, it is enough to send the notice before it expires — by e-mail to the Seller's address or by post. You may use the form below these terms, but it is not obligatory.

  3. 3.

    The Goods must be sent back without delay, no later than 14 days after submitting the notice. The Buyer bears the direct cost of returning them.

  4. 4.

    The Seller refunds all payments received, including the cost of the cheapest delivery offered, within 14 days of receiving the notice. The refund is made by the same means as the payment. The Seller may withhold the refund until the Goods are received or proof of their return is provided.

  5. 5.

    The Buyer may examine the Goods as they would in a shop — unpack, look at and check them. The Buyer is liable, however, for any reduction in the value of the Goods resulting from use beyond such checking, for example chopping, throwing the axe or sharpening the edge.

  6. 6.

    The right of withdrawal applies to all Goods offered in the Shop. Should Goods ever be offered that are made individually to the Buyer's specification and to which this right does not apply, this will be clearly stated in their description before the order is placed. Merely sourcing a standard piece from a supplier is not such an exception.

§ 8. Complaints — lack of conformity with the contract

  1. 1.

    The Seller is liable to the Consumer and an Entrepreneur with consumer rights for any lack of conformity of the Goods with the contract existing at the time of delivery and becoming apparent within two years of that time.

  2. 2.

    A lack of conformity that becomes apparent within this period is presumed to have existed at the time of delivery.

  3. 3.

    In the event of a lack of conformity, the Buyer may demand repair or replacement of the Goods. If repair and replacement are impossible or would involve disproportionate costs, or if the Seller fails to carry them out within a reasonable time or refuses, the Buyer may declare:

    • a)a price reduction — in proportion to the reduced value of the Goods;
    • b)withdrawal from the contract — unless the lack of conformity is minor.
  4. 4.

    Complaints are submitted to the Seller's e-mail address. It helps to give the order number, a description of the problem and photos — this speeds up handling but is not a condition for accepting the complaint.

  5. 5.

    The Seller responds to a complaint within 14 days. No response within this period means the complaint is accepted.

  6. 6.

    The costs of repair or replacement, including shipping costs, are borne by the Seller.

  7. 7.

    Liability for conformity of the Goods with the contract does not cover the effects of using the Goods after delivery, in particular:

    • a)corrosion resulting from failure to carry out the care described with the product and in the FAQ;
    • b)chips, bends and breaks resulting from contact with a hard target, including wood, metal and bone;
    • c)wear of the edge, haft and shaft during use;
    • d)abrasion and damage to leather covers, cords and straps;
    • e)damage resulting from use of the Goods contrary to their description — in particular using a decorative piece for chopping or throwing, striking stone or metal with the blade — as well as the natural patina of brass and silver.
  8. 8.

    The Seller does not provide a separate commercial guarantee. The rights described in this section arise from the law and apply regardless.

§ 9. Age restrictions and safety

  1. 1.

    The Goods are sold to adults only. By placing an order, the Buyer declares that they are at least 18 years old.

  2. 2.

    The axes, spearheads and other items offered in the Shop are not weapons within the meaning of the Polish Weapons and Ammunition Act, and owning them in Poland requires no permit. This does not release anyone from responsibility for how they are used.

  3. 3.

    The Goods are not toys. Carrying them in public places may be treated as an offence. Only pieces explicitly described as intended for re-enactment are suitable for re-enactment combat, and only with proper protective equipment.

§ 10. Personal data

  1. 1.

    The controller of the Buyers' personal data is the Seller.

  2. 2.

    The rules of data processing, retention periods and the rights of data subjects are described in the Privacy policy.

§ 11. Out-of-court dispute resolution

  1. 1.

    The Consumer may use out-of-court methods of handling complaints and pursuing claims, in particular:

    • a)contact a district or municipal consumer ombudsman or a consumer protection organisation in Poland;
    • b)request mediation from the provincial inspector of the Trade Inspection (Inspekcja Handlowa);
    • c)apply to the permanent consumer arbitration court at the provincial Trade Inspection office.
  2. 2.

    Information about these procedures is available on the website of the Polish Office of Competition and Consumer Protection (UOKiK) and from consumer ombudsmen. Consumers from other EU countries can also get free help from the European Consumer Centre in their own country. Using these procedures is voluntary and requires the consent of both parties.

  3. 3.

    The European ODR platform ceased operation on 20 July 2025 and is no longer a way of resolving disputes.

§ 12. Final provisions

  1. 1.

    Matters not governed by these terms are subject to Polish law, in particular the Civil Code and the Consumer Rights Act of 30 May 2014.

  2. 2.

    A Consumer whose habitual residence is in another European Union country retains the protection afforded by the mandatory provisions of their own country — the choice of Polish law does not remove it.

  3. 3.

    No provision of these terms limits the Consumer's rights under mandatory provisions of law. In the event of a conflict, those provisions prevail.

  4. 4.

    These terms are published in Polish and in translations into other languages. In the event of discrepancies between versions, the Polish version prevails.

  5. 5.

    The Seller may change these terms for important reasons, for example a change in the law or in the way orders are fulfilled. Orders placed before the change are governed by the terms in force when they were placed.

  6. 6.

    These terms apply from 11 October 2026.
